PENERAPAN RESTORATIVE JUSTICE PADA KECELAKAAN LALU LINTAS

Abstract

Approach restorative justice is an alternative settlement of criminal problems with an emphasis on problem/conflict recovery and balancing in society, namely by restorative justice. Settlement policy through restorative justice This is to create a balance between victims and perpetrators, then the handling of criminal cases can run flexibly so that it is not rigid by requiring justice. The research conducted by this writer when viewed from the source of the data is a normative juridical research. Normative juridical, namely legal research conducted by reviewing literature or data as a secondary basis for research by conducting a search of regulations and literature related to the problem under study. The application of restorative justice in the settlement of traffic accident cases resulting in death in its settlement focuses on recovering the victim not on punishing the perpetrator, with a meeting between the perpetrators and the victim in hostilities an opportunity to make peace without having to continue the legal process due to an accident that occurred not because of the will perpetrator but an accident that was not expected to occur and then the perpetrator and the victim jointly seek a fair solution not to continue the legal process that applies by pouring out the contents of the peace agreement with witnesses from both parties and the peace document for the traffic accident.
